Indictments Handed up Oct. 6

COURT HOUSE – A Cape May County grand jury handed up the following indictments Oct. 6:
Zachary Trost, Fontel F. Toland III
On June 7, in Ocean City, Zachary Trost and Fontel Toland, 23, allegedly used force to rob two individuals, one of whom was a juvenile. They were allegedly in possession of a deadly weapon when they committed the crime. This week the grand jury handed up indictments against the two for robbery, in the first degree, conspiracy to commit robbery, a second degree crime, and aggravated assault in the third degree. First degree crimes can carry a prison sentence of 10 to 20 years or more.
Carlos Davila
Carlos Davila, 53, of Rio Grande was indicted for violation of community supervision, third degree. Davila had previously been convicted of sexual assault in February 1996 in Cape May County. Conditions of his special sentence were violated when he failed to refrain from purchase, possession or use of alcohol in the period from July through August.
Guglielmo L. Ficco
The grand jury indicted Guglielmo Ficco on two counts of burglary in the third degree. Ficco allegedly entered two automobiles on June 16 in Middle Township with the intent of seeking valuables. The cars were both Kias, a 2014 Kia Soul and a 2012 Kia Forte. Third degree crimes can result in a sentence of up to five years in prison.
Donte T. Alston-Harris
Donte Alston-Harris allegedly unlawfully entered a residence on West Buttercup Road in Wildwood Crest April 12. He is charged with having taken property valued in excess of $500 and then seeking to sell said property knowing it to be stolen. Alston-Harris was indicted for burglary, theft and fencing, all in the third degree.
Duncan W. McNeal
On a busy summer weekend  night for Wildwood police, one in which they made 30 arrests according to police reports, Duncan McNeal, 40, of North Cape May, was arrested for possession of heroin. McNeal allegedly tried to conceal or destroy evidence and fled the scene, and attempted to elude police. McNeal was indicted for possession of a controlled dangerous substance (CDS), third degree and for hindering apprehension and resisting arrest, both fourth degree.
Jennifer L. Romano, Whitney J. Mothershead
Over a period of two months from April to June in Dennis Township, Jennifer Romano and Whitney Mothershead allegedly took property belonging to a relative of Mothershead with the intent of having Romano sell the property. Since the value of the movable property was in excess of $500, the two were indicted for third degree theft along with conspiracy, third degree, and fencing, third degree.
Josue Martinez-Ruiz, Annette L. Ramis
On July 10, in Wildwood, Josue Martinez-Ruiz, 27, of Wildwood, and Annette L Ramis, 44, of Millville, were arrested for possession of heroin, a Schedule I drug. At that time, Martinez-Ruiz was entrusted with care of two children, ages 2 and 3.  The indictment alleges that he endangered the welfare of the children. Both individuals were indicted for possession in the third degree. Martinez-Ruiz was also indicted for endangering the welfare of a child, 2 counts, both second degree offenses.
Carmine Scarpelli
Carmine Scarpelli was indicted for possession of a CDS, third degree, intent to distribute marijuana, fourth degree, prohibited weapon, fourth degree, and most seriously, possession of a weapon while committing a CDS crime, second degree. The incident occurred in Ocean City March 8.  While accused of intent with regard to the marijuana, Scarpelli was found to be in possession of a Schedule IV drug, Alprazolam.  The weapon in question was a switchblade knife.
Michael Smith
Michael Smith, 40, of Whitesboro, was indicted for shoplifting, third degree. Smith allegedly took merchandise valued in excess of $500 from a Rio Grande store June 11. Just two weeks later, Smith was arrested again for shoplifting by Middle Township Police June 28.
Serena M. Schick
Serena Schick allegedly forged and cashed six checks against the account of a single individual at a bank in Lower Township. This was done over a four day period from Dec.10 to 14, 2014. The value of the checks totaled $3,880.  Schick was indicted for forgery, uttering a forged instrument, and theft, all third degree.
The individuals are only charged with the offenses and are presumed innocent until proven guilty.
