COURT HOUSE – A Cape May County grand jury handed up 12 indictments Sept. 6. The abbreviation for controlled dangerous substance used below is CDS.
Haronid Falcon
Haronid Falcon, 27, a citizen of the Dominican Republic residing in Wildwood, is accused of luring two juvenile males, ages 13 and 14, to a secluded spot where he attempted to perform sex acts with them. He was indicted for second-degree sexual assault, two counts of third-degree endangering the welfare of a child, two counts of third-degree passing obscene material to a minor, and two counts of fourth-degree criminal sexual contact.
Falcon was lodged at the Cape May County Correctional Center when he was unable to meet the $100,000 bail.
Christiena McKinstry
Christiena McKinstry, 27, of Wildwood, was indicted for possession of fourth-degree possession of a prescription legend drug for which she had no prescription.
Joshua B. Gist
Joshua Gist, 32, of Atlantic City, allegedly “used force” against a couple when he robbed them while armed with a wooden chair arm. He was indicted for second-degree robbery, possession of a weapon for unlawful purposes, third degree, and unlawful possession of a weapon, fourth degree.
Eduardo Rodriguez
Eduardo Rodriguez, 72, of York, Pa., was arrested in Wildwood in March for possession of a loaded Mossberg International .22 caliber rifle. He was indicted this week for unlawful possession of a weapon, third degree.
James Silcott, Emmanuel Jimenez
Middle Township Police Street Crimes Unit officers witnessed an alleged “hand-to-hand transaction” involving 35 bags of heroin in Rio Grande. Two men allegedly involved were James Silcott, 54, of Villas, and Emmanuel Jimenez, 30, of Burleigh. Police also claim that Silcott briefly attempted to flee the area while canceling evidence. Both were indicted for possession of a CDS, third degree. Jimenez was also indicted for distribution of a CDS, third degree.
Silcott’s alleged attempt to flee and conceal evidence earned him additional counts for fourth-degree resisting arrest, hindering apprehension, and tampering with physical evidence.
Nathan Smith
Nathan Smith, 19, was indicted for fourth-degree criminal mischief for allegedly entering a dwelling in Sea Isle City when he knew “he was not privileged to enter.”
Kevin Barnes
Kevin Barnes, 18, of Woodbine, allegedly stole prescription drugs from a relative and ingested them. He was arrested, treated at Cape Regional Medical Center, and then charged. Barnes was indicted for third-degree theft and possession of a CDS, along with fourth-degree possession of a prohibited weapon. Police say they found him in possession of a butterfly knife.
Nicholas Busher
Nicholas Busher, 36, of Brigantine, was arrested in Wildwood for criminal mischief, fourth-degree when he allegedly damaged the property of someone else with a baseball bat causing damage more than $500. Busher was also indicted for third-degree possession of a weapon for unlawful purposes and fourth-degree unlawful possession of a weapon.
Separate indictments for possession of a CDS, third degree
Joseph Aletriz, Jasson Baker, 28, of North Wildwood. Brian Chase, 29, of Cold Spring, James Barbera, and Robert Lanza, 34, of Wildwood were each indicted separately for possession of a CDS.
For all but Lanza, the drug involved was heroin. Lanza allegedly possessed cocaine. Chase and Barbera were also together charged with conspiracy to possess a CDS.
The above individuals are only charged with the offenses and are presumed innocent until proven guilty.
