Indictments Filed Sept. 10

COURT HOUSE – A Cape May County grand jury handed up 13 indictments Sept. 10. 
The abbreviation CDS below stands for controlled dangerous substance.  
A “certain person not to have weapons” charge can be made against an individual found in possession of a weapon, even though a previous felony conviction banned weapons possession. 
All individuals listed are presumed innocent unless proven guilty.
Scott J. Swain
Scott Swain, 53, of Port Elizabeth, was arrested in Lower Township July 4 and charged with criminal sexual contact, false imprisonment and simple assault. A subsequent investigation implicated Swain in sexual offenses against three victims dating back to 1997.
Swain was indicted for first-degree aggravated sexual assault and two counts of second-degree sexual assault of a victim in the period between 1997 and 2000.
A second set of counts pertain to a separate victim in 2017 involving fourth-degree criminal sexual contact. Those charges from the 2017 incident also include second-degree witness tampering.
A third victim was subjected to attempted sexual assault, second degree, along with fourth-degree criminal sexual contact and third-degree criminal restraint. The most recent incident occurred July 3, the day before Swain’s arrest.
Swain is not listed among the current inmates at the Cape May County Correctional Facility.
Robert Vanliew
Robert Vanliew, 31, of Erma, is facing an eight-count indictment stemming from an April 28 incident in Middle Township. The indictment includes two third-degree counts for making terroristic threats to kill a female victim and criminal restraint. Two second-degree counts involve danger to 10 and 7-year-old children leading to charges of endangering the welfare of a child.
Weapons charges were also involved with the indictment stating that Vanliew was in possession of a knife, leading to a third-degree count for possession of a weapon for unlawful purpose and fourth-degree unlawful possession of a weapon. An earlier conviction of possession of a CDS in 2016 led to a fourth-degree certain person count due to his possession of a knife. Vanliew faces a third-degree count for witness tampering.
Susan M. Tonkinson
Susan Tonkinson, of Upper Township, was indicted for third-degree possession of a CDS, methamphetamine.
Joylynne M. Boyle 
Joylynne Boyle, 35, of Villas, is facing two second-degree counts for aggravated assault on a child and endangering the welfare of a child.
Matthew A. Cropper 
Matthew Cropper, 21, of Court House, was indicted for second-degree burglary. The indictment states that Cropper illegally entered a residence on New Jersey Avenue West in Villas. In the course of the burglary, Cropper is said to have bodily injured the occupant.
Walter J. Gillespie
Walter Gillespie, of Ocean City, is facing a third-degree count for theft by deception.
Christine H. Gildiner 
Christine Gildiner was indicted for the third-degree theft of a 2006 Chrysler automobile in Middle Township in August.
Samantha F. Fernandez 
Samantha Fernandez, of Middle Township, was indicted for possession of a CDS, cocaine, and possession with intent to distribute, both counts were in the third degree. A fourth-degree count was also present in the indictment for intent to distribute drug paraphernalia.
Dillon M. Plumley
Dillon Plumley, of Wildwood, faces three second-degree counts for endangering the welfare of three children ages 5, 3 and 2-years-old.
Michael B. Sebastian, Jr.
Michael Sebastian, Jr., of Ocean City, is accused of threatening to hurt a male victim and causing over $2,000 worth of damage to that individual’s property. Sebastian was indicted for making terroristic threats and criminal mischief, both in the third degree.
Matthew K. New
Matthew New, of Lower Township, faces two third-degree counts for possession of a CDS, fentanyl, and distribution of a CDS.
Jeffrey J. Kern
Jeffrey Kern, of Dennis Township, was indicted on one count of making terroristic threats, third degree.
Gonzalo Soto, Brandon N. Soto
Gonzalo Soto, 40, of Wildwood, was indicted for maintaining a CDS facility, a first-degree count. Along with that charge, Soto faces counts for second-degree distribution of a CDS, heroin, third-degree possession of a CDS and third-degree money laundering. Two fourth-degree counts were also added for possession and possession with intent to distribute Flouro-ABD.
Brandon Soto, 19, of Wildwood, was added to the single count of possession of a CDS, third degree.
