Indictments Filed Oct. 10

COURT HOUSE – A Cape May County grand jury handed up 20 indictments Oct. 10. The abbreviation CDS below stands for controlled dangerous substance. 
Paul B. Kline
Paul Kline, 49, of Ocean City, was indicted for first-degree murder. Kline allegedly strangled the woman he was living with in an Ocean City apartment.
James Matthews and Matthew Donnelly
James Matthews, 24, of Villas, allegedly shot a man in the abdomen with a rifle during a drug deal gone awry in Dennis Township. Matthews was indicted on one count of attempted murder and one count of robbery, each in the first degree. Mathews also faces a second-degree count for possession of a weapon for unlawful purposes.
Matthew Donnelly shared a count with Matthews for second-degree conspiracy to commit robbery.
Owanayzia Nelson, Darnell Wellingham, Harold Corbin and Breland Roach
On July 4, Owanayzia Nelson, 23, and Harold Corbin, 25, both of Harrisburg, Pa., and Darnell Wellingham, 26, and Breland Roach, 26, both of Philadelphia, allegedly assaulted lifeguards and responding police in Ocean City. According to police reports, the four were drunk on the beach in the dry town. Each of the four men was indicted for third-degree assault.
Scott C. Swayngim
In another July 4 incident, Scott Swayngim, 49, of Rio Grande, allegedly knowingly damaged Middle Township property. He was indicted for fourth-degree criminal mischief.
Luiz Gonzalez
Luiz Gonzalez, 31, of Wildwood, faces an eight-count indictment, including two counts of possession of a CDS, possession with intent to distribute, and intent to distribute within 1,000 feet of a school, each count in the third degree. In addition, the amount of heroin involved, allegedly over 2,000 bags, led to another charge of possession with intent to distribute in the second degree.
Gonzalez was also allegedly within 500 feet of public property, making another two counts for possession with intent, second degree. 
George Gaorfal and Ricardo Mercado-Martinez
George Gaorfal, 45, and Ricardo Mercado-Martinez, 37, were arrested in Wildwood in August on drug charges. The two were indicted for third-degree possession of a CDS and possession with intent to distribute. The presence of a 13-year-old added a count for endangering the welfare of a child, second degree.
Richard Irons
Richard Irons, 33, of Villas, was indicted for possession of a CDS, heroin, in Lower Township in August.
Shannon McCarthy
Shannon McCarthy, a Sheriff’s Department officer, was indicted for second-degree official misconduct, along with two fourth-degree counts for impersonation and retaliation for past official action.
According to the indictment, McCarthy sought to harm another individual in retaliation for a past action. McCarthy allegedly impersonated a command officer in the Sheriff’s Department when “submitting news tips to the Cape May County Herald” purporting to come from that command officer.
The tips were allegedly passed to the newspaper in April and May of this year.
Kyle Sausto
Kyle Sausto, 24, of Wildwood, faces an indictment for possession of a weapon for unlawful purposes, third degree, and unlawful possession of a weapon, fourth degree.  The weapon was a knife.
Anthony Moyer
Anthony Moyer, 53, of Villas, was indicted for third-degree aggravated assault and possession of a weapon for unlawful purposes, along with fourth-degree unlawful possession of a weapon. The weapon in question in this indictment was a pair of vice grip pliers.
Robert Orta
In yet another case involving weapons charges, Robert Orta, of Wildwood, was indicted for unlawful possession of a weapon and possession of a prohibited weapon, each in the fourth degree. The weapon in question was a set of metal knuckles.
Justin Davis
Justin Davis, 23, of Court House, allegedly passed $100 bills he knew to be counterfeit at a convenience store and a supermarket in Middle Township. He was indicted on two counts of uttering a false instrument, each third degree.
Roosevelt Defrietas
Roosevelt Defrietas, 50, of Wildwood, was indicted for fourth-degree distribution of marijuana and third-degree distribution within 500 feet of public property. Defrietas was indicted on the same charges of distribution of marijuana in April.
Gina Famiano
Gina Famiano, 35, of North Wildwood, allegedly “removed herself from official detention” in July in Wildwood City. She was indicted for third-degree escape.
Kelly Gales
Kelly Gales, 40, of Erma, was indicted for third-degree sale of a simulated document along with fourth-degree counts for hindering apprehension and resisting arrest.
Jasmine Holland
Jasmine Holland, 31, of Millville, allegedly entered a national chain store in Middle Township Aug. 18 and unlawfully took over $200 worth of merchandise. She was indicted for fourth-degree shoplifting.
Edwin Villanueva-Rivera
Edwin Villanueva-Rivera, 23, of Wildwood, was indicted for possession of a CDS, heroin, in the third degree.
Ian Williams
Ian Williams, owner of a property on 4th Street in West Cape May, allegedly set a fire at the property “with the purpose to collect on the insurance.” The fire endangered five individuals including two children less than one-year-old. 
Williams was indicted for second-degree arson, two counts of third-degree endangering the welfare of a child and second-degree insurance fraud.
David K. Urquhart
In 1992, David Urquhart, 42, of Wildwood, was convicted of criminal sexual contact. That conviction subjected him to Megan’s Law requirements to report any change of address within a specified time period.
Urquhart was indicted for failure to register a change of address, third degree.
Shevindra Talwatte 
Shevindra Talwatte, 29, of Villas, was indicted for attempted burglary, third degree, and resisting arrest, fourth degree. Talwatte allegedly tried to gain unlawful entrance to an automobile and fled from police officers.
All individuals indicted are presumed innocent until proven guilty.
