Indictments Filed May 30

COURT HOUSE – A Cape May County grand jury handed up 14 indictments May 30. The abbreviation CDS below stands for controlled dangerous substance. The crime of certain person below stands for “certain person not to have a weapon.”  
Individuals convicted of a felony are not allowed to carry a weapon at any time. Certain person charges are either in the second or fourth degree depending on the weapon. If the weapon is a gun, the charge will be second degree. 
Daniel Olvera
Daniel Olvera, 35, of North Wildwood, was indicted on eight counts of sexual assault, sexual contact, and endangering the welfare of a child. In a period from August 2016 to April 2017, Olvera allegedly repeatedly assaulted a minor between the ages of 13 and 16.  Each instance involved the same victim.
Olvera faces three counts of aggravated sexual assault in the first degree, one count of third-degree aggravated criminal sexual contact, and four separate counts of endangering the welfare of a child, two in the second degree and two in the third degree.
Olvera is housed at the Cape May County Correctional Center with no bail possible.
Scott Gushea
Scott Gushea, 23, of Villas, was indicted for second-degree sexual assault and third-degree endangering the welfare of a child. The indictment claims that Gushea “had supervisory or disciplinary power” over the victim who was “at least 16 but not yet 18.”
Tony Driscoll Jr.
Tony Driscoll, 31, of Villas, was indicted for making terroristic threats and possession a weapon for unlawful purposes, each in the third degree. Over the Labor Day Weekend 2016, in Wildwood Crest, Driscoll allegedly threatened to kill a female victim who later reported the incident to police. A third count of unlawful possession of a weapon, fourth degree, was also part of the indictment.
Craig Byrd
Craig Byrd, 39, of Wildwood, was indicted for a fourth-degree certain person due to the fact that he was allegedly found to be in possession of a “box cutter-style knife.” A 2009 conviction for distribution of a CDS within 1,000 feet of school property meant that Byrd was ineligible to carry a weapon.
Stephen Cooper
Stephen Cooper, 19, of Green Creek, was indicted for possession of a CDS, alprazolam, third degree along with fourth-degree possession with intent to distribute marijuana.
Gerald Dearie
Gerald Dearie, 32, of West Wildwood, was indicted for aggravated assault, third degree. Dearie’s alleged assault on a male victim occurred in West Wildwood March 16.
Christian J. Murray
Christian Murray, 33, of Wildwood, was indicted for aggravated assault on a police officer and resisting arrest, both in the third degree.
Devon Onorato
Devon Onorato, 21, of Erma, was indicted earlier in May for second-degree burglary and associated charges. This week the grand jury added two counts of third-degree resisting arrest and second-degree escape.
Onorato is lodged at the Cape May County Correctional Center which lists 12 separate charges related to his incarceration.
Demetrius T. Polk Jr.
Demetrius Polk was arrested in Sea Isle City for having more than five dosage units of a prescription drug for which he had no prescription. He was indicted for fourth-degree prescription legend drug.
Jason Poole
Jason Poole, 39, of Villas, was indicted for attempting to defraud the administration of a drug test, third degree, along with possession of a device to defraud a CDS test, fourth degree. Poole was part of an intense supervision program (ISP).
Carollee Schick
Carollee Schick, 55, of North Cape May, has been indicted several times this year. This week the grand jury indicted Schick for possession of a Mossberg Model 346 Bolt Action .22 caliber gun. The formal count was certain person, second degree.
A 2009 conviction for possession of a CDS with intent to distribute made Schick an individual for whom it is illegal to possess a weapon.  A conviction on a second-degree offense can carry a jail term of 5 to 10 years.
Schick was not listed at the Cape May County Correctional Center.
Steven M. Szymborski
Steven Szymborski, 44, of Villas, was indicted for third-degree theft for taking more than $500 worth of property from a car stereo merchant in Lower Township.
Herbert Tozer
Ed. Note: This is not the same Herbert Tozer who was indicted for murder following an altercation at a Rio Grande motel in January.
Herbert Tozer, of Wildwood, was indicted for aggravated assault and endangering the welfare of a child, two counts. All three counts were in the second degree.
Jessica Osborn, James Osborn
Jessica, 27, and James, 29, Osborn, both of Tuckahoe, allegedly took bags from drop-off bins. The bags contained items intended to help the military families. The police reported that the couple said they found jewelry in the bags that they were able to pawn locally.
The grand jury indicted the couple on third-degree theft and conspiracy counts as well as third-degree fencing and conspiracy counts. 
The above individuals are presumed innocent until proven guilty.
