Indictments Filed May 24

COURT HOUSE – There were 22 indictments filed by a Cape May County grand jury May 24.
Joint investigations by the Cape May County Prosecutor’s Office and local police departments resulted in several drug-related indictments this week. The first four indictments listed were products of such joint cooperation.
Hector E. Cruz-Hernandez
Hector Cruz-Hernandez, 30, of North Wildwood, was indicted for a series of drug-related charges, including two counts of distribution of a controlled dangerous substance (CDS), third degree, distribution of a CDS within 500 feet of public property, second degree, and within 1,000 feet of a school, third degree, two counts of possession with intent to distribute, third degree, and three second degree charges of endangering the welfare of a child.
The indictment lists multiple incidents in January and February, both in North Wildwood. Added charges resulted from the proximity to Albert Allen Memorial Park and Wildwood Catholic High School. The children, for whom Cruz-Hernandez had a legal responsibility to care for, were ages 5, 4 and 1-years-old. The indictment alleges that they met the legal definition of abused or neglected children.
Kelvin Morales
Officers from the Prosecutor’s Office and the Middle Township Police Department served a search warrant on the Burleigh motel room of Kelvin Morales, 33. Evidence led to an indictment on two counts of possession of a CDS, both heroin and cocaine, as well as possession with intent to distribute, all third degree. The quantity of heroin being over half an ounce added the second degree count of possession with intent to distribute. The search occurred on Jan. 21.
Vincent Oglesby
In December 2015, a search warrant was similarly used to enter a Rio Grande motel room belonging to Vincent Oglesby, 21. The result of a prior investigation, the search allegedly showed Oglesby in possession of both heroin and cocaine. He was indicted on two counts of possession of a CDS and two counts of possession with intent to distribute, all third degree.
Kahyyam Gales, Kahlil Gittings
Kahyyam Gales, 37, and Kahlil Gittings, 20, both of Wildwood were similarly subjects of a joint investigation in August 2015. This week they were indicted for possession of a CDS, heroin, possession with intent to distribute, and possession with intent to distribute within 1,000 feet of a school, Wildwood High School. Each count was in the third degree.
Robert Kurtz
The indictment against Robert Kurtz, of Lower Township, alleges that he unlawfully possessed a weapon, a Charter Arms 2000 revolver, for which he had no valid permit. Kurtz faces a count of unlawful possession of a weapon, second degree. A second degree conviction can carry a 5 to 10-year prison term.
Dustin Piccolo
Dustin Piccolo, 33, of Cape May, was stopped and arrested for a DWI in Middle Township on March 4. The presence of a 10-year-old child endangered by the driver’s negligence led to a charge of second degree endangering the welfare of a child.
Mark Burkett
In March, police were called for a domestic violence complaint. Further investigation led to charges against Mark Burkett, 32, of Woodbine, for fourth degree possession of a prohibited weapon and another fourth degree count for possession of several knives while being a certain person not permitted to possess weapons. Burkett was convicted of felony burglary in 2003.
Carlos Aborresco
Carlos Aborresco, 48, of Burleigh, was indicted for third degree distribution of a CDS, heroin based on an arrest made Dec. 15, 2015.
Stephanie Cianci
Stephanie Cianci, 28, of Cape May, was stopped for a DWI in Middle Township, March 30. She now faces the added charges of possession of a CDS, third degree. The drug involved was clonazepam.
Jerrod Rutherford, Christopher Zammit
Jerrod Rutherford, 27, of Burleigh, and Christopher Zammit, 42, of Villas, were indicted for receiving stolen property, third degree. The indictment alleges that the two, at various times in 2016, came into possession of property stolen from Stone Harbor Marina. The property was valued at more than $500, making the offense third degree.
Christine Pagan-Perez, Michael Milosky
The grand jury indictment alleges that Christine Pagan-Perez and Michael Milosky, both of Wildwood, engaged in a conspiracy to distribute a CDS within 500 feet of public property, making the counts for both the conspiracy and two counts of actual distribution second degree. The two also face two third-degree charges for possession of a CDS, heroin, and distribution within 1,000 feet of a school, Wildwood High School, two counts of each. The public property in question was the George Boyer Museum.
The incidents leading to multiple counts allegedly occurred in July in both Wildwood and Lower Township.
Nicholas Horn
Nicholas Horn, of Dennis Township, was indicted for fraudulent use of a credit card and theft, both third degree. The indictment alleges that Horn came into possession of a credit card belonging to the federal government. It further alleges that he used the card to purchase goods and services on various dates from December 2013 to March 2015.
The individuals are only charged with the offenses and are presumed innocent until proven guilty.
