COURT HOUSE – A Cape May County grand jury handed up 14 indictments May 16. The abbreviation CDS below stands for controlled dangerous substance. The crime of “certain person” below stands for certain person not to have a weapon.
Individuals convicted of a felony are not allowed to carry a weapon at any time. “Certain person” charges are either in the second or fourth degree depending on the weapon. If the weapon is a gun, the charge will be second degree.
Devon Onorato
The indictment claims that during the course of a burglary, Devon Onorato, 29, of Erma, displayed a deadly weapon and threatened a victim.
This week, Onorato was indicted for second degree burglary, third degree terroristic threats and possession of a weapon for unlawful purposes, a knife, along with fourth degree unlawful possession of a weapon.
William McNeal
William McNeal, 55, of Wildwood, was indicted for possession with intent to distribute marijuana in an amount less than one ounce, a fourth degree offense. The indictment further claims that McNeal was within 500 feet of public property, Maxwell Field, producing a second count in the third degree.
Yvonne M. Montalvo
Yvonne Montalvo, 26, of Wildwood, was indicted for third degree theft for taking over $500 of movable property from a local restaurant. She also allegedly reported events to police which she knew to be untrue leading to a second count of false report to law enforcement, fourth degree.
Keith Wang
Keith Wang was arrested Feb. 10 in Middle Township for allegedly impersonating another person in an attempt “to obtain benefits for himself.” He was indicted for impersonation, fourth degree.
Edward Lunn
On Feb. 9, Middle Township Police responded to a call at a store on Route 9 in Burleigh. Edward Lunn, 35, of Burleigh, had allegedly attacked a male victim in the store and then followed by cutting the victim with a knife in the parking lot. The victim was treated and released at Cape Regional Medical Center.
Lunn had previously been convicted of possession with intent to distribute CDS in Baltimore, Md.
Despite the previous conviction and the serious nature of the assault, Lunn was booked and released on a summons.
Lunn was indicted for second degree aggravated assault and third degree possession of a weapon for unlawful purposes. Two fourth degree counts were also included for unlawful possession of a weapon and certain person.
Robert Luebberman and Andrew Gustchen
In separate indictments, Robert Luebberman, 44, of Villas, and Andrew Gustchen, 30, of Wildwood, were indicted for third degree possession of a CDS, heroin.
William Fowler
William Fowler, of Lower Township, was indicted on one count of endangering the welfare of a child, second degree. The indictment alleges that Fowler “engaged in sexual conduct” with a 15-year-old victim.
Jeffrey Fendt
Between Dec. 10, 2016 and Dec. 23, 2016, Jeffrey Fendt, of Lower Township, allegedly unlawfully took over $500 worth of property from a victim. He was indicted for third degree theft.
Robbie Ellison
Robbie Ellison, of Wildwood, allegedly assaulted a health care worker at Cape Regional Medical Center March 8. He was indicted for aggravated assault, fourth degree.
Michael Bubb
On Dec. 30, 2016, in Upper Township, Michael Bubb allegedly engaged in sexual assault of a 15-year-old female victim. The indictment claims that Bubb knew the victim was “physically helpless or incapacitated” and unable to give consent. Bubb was indicted for first degree aggravated sexual assault and third degree endangering the welfare of a child.
Claudia O’Leary and Dallas Smith
Claudia O’Leary and Dallas Smith, both 20, and from Cape May City, were indicted on 13 separate counts of third degree burglary along with single counts for conspiracy and theft, third degree.
The indictment claims that on diverse dates in October 2016, the two unlawfully entered vehicles in Middle Township ranging from high end luxury cars to pickup trucks to modest compacts, taking movable property that was aggregated into the one theft count.
The two were released pending court dates.
Michael Cori, Richard Winter and Khelena Kireyeva
During the same month of October 2016, when Middle Township Police were dealing with a rash of car burglaries, State Police, in Upper Township, arrested Michael Cori, 29, Richard Winter, 32, and Khelena Kireyeva, 37, all of Sea Isle City, for a rash of home break-ins. According to the indictment, the three “burglarized residences to obtain property to sell for cash and/or drugs.”
Police reports say that the three were apprehended after police responded to an activated home security alarm. Witnesses describe a vehicle leaving the home which was located and stopped nearby.
Nelson Wiseman
Nelson Wiseman was arrested in Wildwood City March 25 and charged with a number of weapons violations. Wiseman was indicted on three separate counts of unlawful possession of a weapon, each in the second degree, along with one count of fourth degree prohibited weapon.
The indictment lists a Smith and Wesson .38 revolver, a Smith and Wesson 9mm Luger pistol and a Beretta semi-automatic pistol. The prohibited weapons were hollow point bullets.
The above individuals are presumed innocent until proven guilty.
