COURT HOUSE – A Cape May County grand jury handed up 16 indictments Feb. 21. The abbreviation CDS below stands for controlled dangerous substance.
Austin Gaile
Austin Gaile, 19, from New York, allegedly engaged in an internet prank that went very wrong in the middle of the August tourist season in Wildwood.
Police say that Gaile entered a crowded elevator in a Wildwood motel and drenched himself in a liquid, thought to be gasoline. He then attempted to light himself on fire causing distress and panic among those who shared the elevator. Police say the liquid was actually water.
Gaile was allegedly recording his prank with the hopes of posting it to an online site.
Eight people were in the elevator, including two young children. Officials said the passengers on the elevator were shaken up and momentarily thought their lives in danger.
Gaile’s attempt at internet fame instead landed him in the Cape May County Correctional Center. He was indicted for second-degree false public alarm, third-degree terroristic threats and two counts of third-degree endangering the welfare of a child.
Charles Garvey
Charles Garvey, 48, of Wildwood, was indicted for third-degree bail jumping. The indictment says that Garvey failed to show at the appointed time for a hearing in Superior Court concerning his earlier indictment for possession of a CDS.
Eric Moyer
Eric Moyer, 38, of Villas, was indicted for third-degree theft as a result of a December incident in Middle Township. Moyer was indicted last week on similar theft charges for allegedly taking equipment from trucks belonging to a tree maintenance company.
Michael Pearson
Michael Pearson, 23, of Villas, allegedly entered an apartment on Bayshore Road finding the tenant at home. The indictment claims that Pearson did “attempt to inflict bodily injury” on the resident. He was indicted for second-degree burglary and third-degree possession of a CDS.
David Rush
David Rush, 34, of North Cape May, was indicted for aggravated assault, third degree. The October incident, according to the indictment, met the definition of “domestic violence.”
Damanik Ellis, Marc Desalis
In separate indictments for third-degree possession of a CDS: 24-year-old Damanik Ellis, of Villas, was indicted for possession of fentanyl, Marc Desalis, 24, of Erma, was allegedly in possession of heroin.
Kelly Costanzo
Kelly Costanzo, 58, of Philadelphia, was participating in an ongoing monitoring program when she allegedly tried to defraud a drug test. Costanzo was indicted for third-degree attempt to defraud a drug test and fourth-degree possession of a device to defraud such test.
Benjamin Benezet
In May 2002, Benjamin Benezet, now 35, of Villas, was convicted of aggravated criminal sexual contact. That conviction placed him under life-long community supervision when not incarcerated. Benezet was indicted for third-degree violation of community supervision for failing to report to a probation officer, failing to attend and complete counseling and failure to reside at the appropriate address.
In October 2016, Benezet was also indicted for the same offense.
Naeem Brown-Rowe
Naeem Brown-Rowe, of Ocean City, was indicted for resisting arrest by attempting to flee following an incident Jan. 1. It was a fourth-degree count.
James Bussey
In Wildwood in October 2016, James Bussey allegedly possessed oxycodone with the intent to distribute. His arrest involved three children, ages 6, 5, and 3, for whom he had a responsibility to care. He was indicted for possession of a CDS and possession with intent to distribute, each count third-degree, as well as three separate counts of second-degree endangering the welfare of a child.
Jose Ruiz
Jose Ruiz, 39, of Millville, was indicted for possession of a CDS, heroin, as well as distribution of a CDS, each count third degree. Two additional counts allege that Ruiz was within 1,000 feet of a school, third degree, and 500 feet of public property, a second-degree offense. The incident occurred in Wildwood in July.
Christine Pagan, Wilson Reyes-Goycochea
Christine Pagan, 29, and Wilson Reyes-Goycochea, 30, both of Wildwood, were indicted for possession of a CDS, heroin.
Justin Lahn, Eric Volpe
Justin Lahn, 24, and Eric Volpe, 36, both of Wildwood, were indicted for possession of a CDS, heroin, third degree and third-degree conspiracy to possess a CDS.
Adam Sanchez, Wilfredo Reyes, Edward Lee
Adam Sanchez, 28, of Bridgeton, and Wilfredo Reyes, 30, of Seabrook, were indicted for third-degree counts of possession of a CDS, distribution of a CDS and conspiracy. Edward Lee, of Wildwood, was added to the single count of possession of a CDS, cocaine.
Lucus Connor, Ashley Forrestel
Lucus Connor, 25, of Ocean City, was indicted for distribution of a CDS, heroin, and third-degree endangering the welfare of two young children, ages 7 and 9. Ashley Forrestel faces a count of second-degree endangering the welfare of a child.
She was, according to the indictment, the individual with a legal duty to care for the children.
The above individuals are presumed innocent until proven guilty.
