Indictments Filed Dec. 8

COURT HOUSE – A Cape May County grand jury handed up the following indictments Dec. 8:
Ernest Davis
On Oct. 3, Ernest Davis, 43, of Lower Township, allegedly fired a shotgun at a female victim in an attempt, according to an indictment this week, to kill her. The incident occurred on the water at a fishery in Cold Spring with the shot fired from an adjacent vessel. The victim’s left foot required amputation at the hospital.
Davis faces indictments for attempted murder, first degree, aggravated assault and possession of a weapon for unlawful purposes, both second degree, and hindering apprehension, third degree.
Davis has a previous conviction for maiming from 1993 in Hampton, Va. As a result of that conviction, he was forbidden to own or carry a weapon, which resulted in an additional certain person indictment in the second degree.
David Flanders
David Flanders, 18, has been lodged at the Cape May County Correctional Center by the County Prosecutor’s Office. Flanders allegedly engaged in sexual assault against a 14-year-old victim. The grand jury indicted Flanders for sexual assault, second degree, and endangering the welfare of a child, third degree.
Nancy Fleming
Nancy Fleming, 70, of Lower Gwynedd, Pa., was indicted for shoplifting merchandize from a West Cape May store valued in excess of $500. The charge is a third-degree offense. The septuagenarian also faces charges for shoplifting in Cape May City on the same day as the incident in West Cape May.
Erika Andrews
According to a release from county Sheriff Gary Schaffer, Erika Andrews, 29, smuggled 48 bags of heroin into the Cape May County Correctional Center by concealing them in a condom inside a body cavity. Andrews had been incarcerated pending transport and as such did not fall into the parameters of those who can be strip searched.
Andrews had exhibited troubling behavior while at the facility which caused an officer to send her to the medical wing for observation. The drugs were subsequently discovered in her cell.
Andrews was indicted for possession with intent to distribute a controlled dangerous substance (CDS), third degree.
Myron Brown, Jr.
Myron Brown was arrested in Sea Isle City Sept. 13 after he allegedly attempted to promote prostitution and used false identifying information when talking with police. He was indicted for promoting prostitution, third degree, false incrimination, fourth degree, hindering apprehension and obstructing the administration of law, both fourth degree, and impersonation, third degree.
Jesse Daisey
Jesse Daisey, 22, of Rio Grande, was indicted for heroin distribution, third degree, and using a juvenile in the commission of a crime, second degree. Daisey, who is lodged at the county correctional center on $75,000 bail, allegedly used a 16-year-old to hold heroin as part of the plan to distribute it.
Joshua Kohn
Joshua Kohn, 41, of Asbury was indicted for endangering the welfare of child, a second degree offense. The child was a 5-year-old for whom Kohn had custody and care at the time of a driving while intoxicated arrest Oct. 3 in Wildwood.
Joshua Velli
Joshua Velli, 24, of Burleigh, was indicted for aggravated arson in the second degree. Velli allegedly intentionally caused an explosion and fire at a structure on Indian Trail Road which damaged four units at the location. A second degree conviction can carry a prison term of five to 10 years.
Michael C. Smith
Michael Smith, 40, of Whitesboro, was arrested for possession of a controlled dangerous substance with intent to distribute in Wildwood Sept. 4. Smith had been arrested for shoplifting three times since June.  Those incidents involved a number of Middle Township merchants. Now Smith has been indicted for possession of cocaine with intent to distribute, third degree.  Since his alleged offense took place within 1,000 feet of Wildwood High School, Smith has an added third degree charge.
Andrew Carrier, George Blum
On Oct. 11 in Wildwood, Andrew Carrier, 27, of Buckhannon, W. Va., and George Blum, 26, of Budd Lake, were stopped by police.  The two allegedly resisted arrest, assaulted officers, and threw bodily fluids. They were both indicted this week for aggravated assault, third degree, resisting arrest and possession of a weapon for unlawful purposes, both third degree, and obstructing the administration of law and throwing bodily fluids, both fourth degree. The weapon listed in the indictment was a skateboard.
Luke Schulingkamp, Kerrin Fitzgerald
On Aug. 20, items of jewelry valued in excess of $500 were taken from a home on Carolina Avenue in Lower Township. The items were later sold to a merchant who buys gold objects. Luke Schulingkamp, 35, and Kerrin Fitzgerald, 28, both of Villas, were indicted for three counts of third degree conspiracy, along with burglary, theft and fencing, all also third degree.
Brian Thompson, George Thompson
Brothers Brian Thompson, 29, and George Thompson, 34, both of Whitesboro, were indicted on a number of weapons charges in Middle Township.
Brian, who had been convicted in 2004 for distribution of controlled dangerous substance, allegedly possessed a RG .38 special revolver without a permit and an AR 15 assault rifle. Along with third degree possession charges, he faces a certain person charge since his previous conviction barred him from possessing guns.
George allegedly possessed a .45 Colt 1911 handgun without a permit. His conviction in 2003 for distribution of a controlled dangerous substance also led to a certain person charge.
Both men were also charged with possession of hollow point bullets.
Charges resulted from a shooting incident Aug. 9 when police responded to a report of gunshots at about 3 a.m.
At that time Brian Thompson was arrested.  Subsequent search and investigation led to charges against George Thompson. 
The individuals are only charged with the offenses and are presumed innocent until proven guilty.
