COURT HOUSE – A Cape May County Grand Jury returned an indictment May 5 against Mihaela Reilly, 25, of Seaville, for charges of death by auto, a second degree crime and violation of law intended to protect public health and safety, a second degree crime.
The State alleges that on July 21, 2014, the defendant was using a hand-held wireless telephone while operating a motor vehicle on Route 9 in Upper Township when she struck and killed a pedestrian, David Loder, 76, of Ocean View.
Prosecutor Taylor advises that persons convicted of second-degree crime are subject to a term of imprisonment of 5 to 10 years in New Jersey State Prison. The case was investigated by the New Jersey State Police-Woodbine and the New Jersey State Police-Fatal Accident Unit.
The charges and allegations contained in the complaint are merely accusations and the defendant is considered innocent unless and until proven guilty.
