NORTH CAPE MAY – Five men who worked as seasonal employees for the Delaware River and Bay Authority (DRBA) filed a lawsuit against the authority Nov. 26, alleging age discrimination as the reason they were passed over for a promotion, according to a report on NJ.com.
Shawn Bulifant, 56, of Court House, Christopher Vernon, 44, of North Cape May, Gary Hughes, 63, of North Wildwood, James McClintock, 54, of Wildwood and Daniel Loper, 59, of Cape May all worked as “able bodied seamen” on the Cape May-Lewes Ferry and applied for a full-time position as an ordinary seaman in 2012. None of the employees were given the promotion, according to the lawsuit, and the jobs were given to three younger people.
The lawsuit alleges that the employees were discriminated against and were retaliated against for filing a complaint to the DRBA executive director.
The lawsuit requests compensation for the men’s lost wages, cost of the lawsuit and other such damages, as well as a trial by jury.
Neelima Vanguri and William Rieser of Philadelphia-based law firm Sidney L. Gold and Associates are representing the five men.
DRBA Public Information Officer James Salmon told NJ.com that as a matter of policy, the DRBA does not issue comment on pending litigation.
