DeMarzo Appeals ‘Cop or Mayor’ Decision

COURT HOUSE — According to Coastal Broadcasting, Wildwood Mayor Gary DeMarzo has appealed Superior Court Judge Valerie Armstrong’s order that forced him to choose between his job as a city police officer and his mayoral seat.
An Appellate Division panel ruled that the two posts hold an inherent conflict of interests. Previously, DeMarzo was allowed remain on unpaid leave from the police department as long as he didn’t vote as a commissioner on matters dealing with public safety.
DeMarzo is questioning a number of issues in his appeal. Coastal Broadcasting reported that DeMarzo asked in the appeal whether the court had jurisdiction to hear this case because a petition for certification was filed; whether the layoff plan for Appellant was acceptable as a resignation; and whether the Court was correct in requiring Appellant to resign as a police officer or resign as a commissioner?
