WILDWOOD — An appellate court has denied Wildwood Mayor Gary DeMarzo’s request to stay a ruling that requires him to either give up his office as mayor or give up his position as a city police officer, reports the Press of Atlantic City.
“The mere filing of a motion for a stay does not automatically stay or otherwise toll the time period established by the court,” Appellate Divison Judge Jose L. Fuentes said in his order, according to the Press of Atlantic City.
Fuentes wrote that DeMarzo failed to follow court procedures for emergent review of the matter. “The motion for a stay is thus denied as moot,” Fuentes wrote.
Since the case was filed against DeMarzo by the city, it is now up to the city to file a motion to enforce the court’s ruling, said Tammy Kendig, spokeswoman for the New Jersey Judiciary.
