OCEAN CITY – A beach supervisor in Ocean City plead guilty to second-degree official misconduct and fourth-degree sexual contact Nov. 2 for having sex with one of his underage employees, NJ.com reports.
Charles Cusack, 52, a retired Ocean City police officer, will not serve any prison time as part of the plea deal reached in court.
According to the report, prosecutors will ask a judge to put Cusack on the state’s sex offender registry when he is sentenced in December. As part of the agreement, Cusack will receive probation. He faced up to 10 years in prison if convicted at trial.
The victim, who has not been named, was a minor when she was hired in July 2012 by Cusak, who was then working as superintendent of beach fee operations.
A lawsuit filed by the victim in Cape May County Superior Court earlier this year alleged that the assaults took place in Cusack’s home, as well as in an office along the Ocean City waterfront that housed the beach badge operations.
