Attorney Fuscellaro Cleared of Federal Charges

CAMDEN – It took 13 months, and providing hundreds of documents to the U.S. Attorney for New Jersey, but Wildwood attorney Seth Fuscellaro had all charges against him dropped and a federal indictment withdrawn Sept. 18.
Fuscellaro of Wildwood Crest continued to work at his solo practice after being arrested in Lower Township Municipal Court July 19, 2012 by FBI agents. He was the municipal public defender at the time. The case involved an ongoing mortgage fraud investigation.
According to Thomas Burke, Fuscellaro’s attorney, the indictment was withdrawn by order of Jerome B. Simandle, chief judge, U.S. District Court for New Jersey.
“I really appreciate the integrity of the U.S. Attorney’ s Office in Camden which reevaluated the case and realized that Mr. Fuscellaro was innocent of these charges,” said Burke.
Burke cited Matthew Smith, assistant U.S. Attorney, who, upon reviewing all files provided, “was persuaded to do the right thing.”
Armed with documents that proved Fuscellaro’s innocence, ‘They filed the motion to dismiss. They were honest. They have a lot of integrity to have pulled their case,” added Burke.
The continuing, multi-state case deals with mortgage fraud. It involved 11 defendants and over $16 million.
“This is tremendous news for him (Fuscellaro),” Burke added. “Had we gone to trial, I believe he would have been acquitted. There was too much evidence that proved he was innocent,” he continued.
In July 2012, Fuscellaro was a partner in the law firm of DeWeese, Stagliano and Fuscellaro, which dissolved Sept. 1, 2012.
