CAPE MAY – Lee A. Herr, 51, of North Wildwood, was arrested in Cape May, May 24 at approximately 7:30 p.m. on disorderly conduct charges.
While on bike patrol in the area of the Washington Street Mall, Cape May Officer Sean Duffy became aware of a dispute in one of the stores there.
His initial investigation revealed that a customer had purchased two books, but had been overcharged approximately $460 and was attempting to correct the error with the merchant, Herr.
Observing that the situation was not being resolved, Officer Duffy separated the two parties and attempted to resolve the matter. It was during this time that Herr attempted to attack the customer by lunging across the counter in the direction of the customer.
Herr was arrested and transported to the Cape May Police Department and charged with disorderly conduct. Additionally, it was discovered that Herr was a wanted person in Pennsylvania and he was charged with being a fugitive from justice.
He was scheduled for his first appearance May 25 at 9 a.m.
The charges and allegations contained in the complaint are merely accusations and the defendant is considered innocent unless and until proven guilty.
